Terms of Service for English Tutoring Services

Article 1 (Purpose):
This Terms of Service Agreement (“Agreement”) governs the use of the English tutoring services (“Service”) provided by Real Life English LLC,
in accordance with the Act on the Consumer Protection in Electronic Commerce, Etc. Its purpose is to set out the rights, duties, and responsibilities of both the Company and its users.
Article 2 (Definitions):
1. “User” means any individual or legal entity who registers for and uses the Service. [Real Life English will be referred to as "The Company"]
2. “Lesson” means any 1:1 or group English tutoring session provided by the Company.
Article 3 (Posting, Effect, and Amendment of Terms):
1. The Company shall post these terms on its service’s initial screen so that users can easily review them.
2. The Company may amend these terms in compliance with applicable laws (e.g., the Consumer Protection Act).
3. When amending, the Company will display the effective date and reasons together with the current and revised terms; if amendments benefit users, they become effective immediately.
Article 4 (Company Information & Transaction Details):
In accordance with statutory requirements for mail‐order businesses, the Company must disclose the following when advertising or displaying transaction terms:

Article 5 (Service Description & Lesson Schedule):
1. Eligible Clients: Adults aged 20 or above, children ages 3 - 19 with written parantal/guardian consent.
2. Lesson Formats: 1:1 or group; online or inperson per individual contract.
3. Scheduling: Specific lesson times and frequency are agreed upon in each user’s separate lesson agreement.
Article 6 (Tuition & Payment):
1. All invoices must be paid 30 calander days, till then the company has the right to provide or withold service.
2. The Company will provide upon client request status of payment.
Article 7 (Rescheduling, Cancellation & Refunds):
1. Standard Requests: Users must notify the tutor by writing at least 48 hours before a scheduled lesson to change or cancel.
2. Emergency Exceptions: In cases of illness, accident, or other emergencies, users may submit supporting documentation (e.g., a medical certificate).
The Company may then approve rescheduling or refund at their discretion.
Article 8 (Liability for Damage):
1. Lessons at Tutor’s Residence (Clients Aged 3–19): Parents or legal guardians shall fully compensate for any damage to or loss of the tutor’s property occurring during the lesson.
2. Lessons at Client’s Residence (All Ages): If a user causes damage during a lesson at their own home, the Company will assume full responsibility and compensate the tutor accordingly.
Article 9 (Privacy & Personal Data Protection):
The Company adheres to the Personal Information Protection Act and the Act on Promotion of Information and Communications Network Utilization and
Information Protection, and publishes a separate Privacy Policy detailing its data‐handling practices.
Article 10 (Disclaimer & Dispute Resolution):
1. The Company is not liable for service interruptions caused by force major events (e.g., natural disasters, government actions).
2. Any disputes arising out of or related to this Agreement shall be submitted to the competent court in the location of the Company’s head office.[court location for gyeongju]
Article 11 (Governing Law):
This Agreement shall be governed by and construed in accordance with the laws of the Republic of Korea, and all related disputes shall fall under the exclusive jurisdiction of Korean courts.

We collect the following information directly from users or their guardians upon registration and during service use:
Identification: Full legal name, date of birth, gender
Contact: Mobile phone number, email address, home address, KakaoTalk ID
Payment: Bank account or card details for tuition payments
Usage Data: Lesson schedules, attendance records
CCTV Footage: Video recordings from fixed position CCTV at the tutor’s residence for safety and security purposes.
3. Purpose of Processing
Personal information is processed for the following purposes only:
1. Service Provision: Scheduling and delivering English tutoring lessons.
2. Payment Processing: Managing and confirming tuition payments.
3. Communication: Sending SMS/email notifications (e.g., payment confirmation, schedule changes).
4. Safety & Security: Monitoring premises via CCTV to ensure the wellbeing of minors and protect Company property.
5. Compliance: Fulfilling legal obligations under Korean law.
4. Retention and Use Period
General Records: Retained for the duration of the contractual relationship plus 5 years for accounting and tax purposes under the Framework Act on National Taxes.
CCTV Footage: Retained for 30 days from recording date and then automatically deleted, except when needed for incident investigation (in which case retained until conclusion).
5. Provision to Third Parties
The Company does not share personal information with third parties except in the following cases:
Payment Gateways & Banks: To process tuition payments.
SMS/Email Service Providers: To send notifications.
Legal Requirements: If disclosure is required by law or by a valid government request.
6. Outsourcing (Consignment) of Processing
To provide certain services, the Company may outsource the following tasks to trusted partners under strict contractual agreements ensuring data protection:
SMS Distribution: [Vendor Name] – mobile numbers, message content

7. Rights of Data Subjects and Their Exercise
Under Articles 35–37 of the Personal Information Protection Act, users (or their legal guardians for minors under 14) have the right to:
1. Access & Rectification: Request viewing or correction of their personal data.
2. Deletion & Erasure: Request deletion of personal data when processing is no longer necessary or unlawful.
3. Processing Suspension: Request suspension of processing for reasons such as legality disputes.
Requests can be made to the contact point listed in Section 1, and the Company will respond without delay.
8. Technical and Managerial Security Measures
To safeguard personal information, the Company implements the following measures:
Encryption: Sensitive data (e.g., payment details) is stored and transmitted using industrystandard encryption (SSL/TLS).
Access Control: Limited access rights based on role, with periodic audits.
Secure Storage: Personal data stored in secure, accesscontrolled environments.
Training: Regular staff training on data protection policies and procedures.
9. CCTV Notice
In compliance with the FixedPosition Video Information Processing Device Installation·Operation Guidelines, the tutor’s residence is equipped with CCTV for the following:
Purpose: Ensuring the safety of minor clients (ages 3–19) and protection of property.
Location & Scope: Cameras cover common areas where lessons occur.
Retention: Footage is stored for 30 days, then automatically deleted.
Manager: [Data Protection Officer], contact as per Section 1.
Signage: Notice of CCTV recording is clearly displayed at entry points.
10. Changes to Privacy Policy
This Policy may be updated to reflect changes in legal requirements or business practices.
Revised versions will be posted on our website with the “Last Updated” date. Continued use of the Service after changes constitutes acceptance.
